James Holmes Won’t Be Charged for Killing Unborn Child

James Eagan Holmes, the Dark Knight Rises Massacre gunman who killed 12 and wounded 58 others, was charged today with 24 counts of murder and 116 counts of attempted murder. He will not, however, be charged for the miscarriage of one of his surviving victims.

There will be no additional homicide charge related to the unborn child lost by victim Ashley Moser, who suffered bullet wounds to her neck and belly when Holmes opened fire at the midnight screening of The Dark Knight Rises on July 20 in Aurora, Colorado.

The AP reports:

Defense attorney Karen Steinhauser, a former prosecutor and current adjunct professor at the University of Denver, said homicide charges in Colorado apply only to those “who had been born and alive.”
